1. Scope

1.1 These General Terms and Conditions (AGB) apply to all contracts, deliveries, and other services Nana House Ericeira provides unless expressly agreed upon in writing.

2. Conclusion of Contract

2.1 The presentation of products and services on our website does not constitute a legally binding offer; it is merely a non-binding invitation to place an order.

2.2 By placing an order via our website, you make a binding offer to conclude a purchase contract. We reserve the right to accept this offer within 14 days by emailing an order confirmation. The contract is only concluded when we send the order confirmation.

3. Prices and Payment Terms

3.1 The prices listed on our website at the time of the order apply. All prices are inclusive of statutory VAT.

3.2 Payment for the goods and services is due immediately upon the conclusion of the contract. Payment can be made via the payment methods offered on our website.

4. Delivery

4.1 Delivery times are specified on our website or in the order confirmation. These are approximate values and may vary. 4.2 Delivery is made to the address specified by the customer. Partial deliveries are permissible, provided they are reasonable for the customer.

4.3 The risk of accidental loss or deterioration of the goods passes to the customer upon delivery.

5. Right of Withdrawal

5.1 According to the statutory provisions, consumers have a right to withdraw. The separate instruction on withdrawal provides detailed information on this right.

6. Liability

6.1 All participants take part at their own risk. We assume no liability for damages, injuries, or losses during the stay or the programs. We assume no liability in the following cases: delays, changes, or postponements in the program/tour schedule due to weather conditions that would endanger the safety of the customer; consideration for group members who are unable to meet the requirements of the tour for unforeseeable reasons such as illness, poor physical condition, or similar; and schedule failures of public transport.

6.2 Nana House accepts no liability for additional costs and expenses incurred directly or indirectly due to force majeure, flight cancellations, accidents, breakdowns of transportation, weather, illness, landslides, blockages due to political unrest, or other causes beyond Nana House's control.  We accept no liability for any loss, injury, or damage to persons, property, or otherwise caused in connection with accommodation, transportation, or other services directly or indirectly by force majeure, fire, accident, strike, theft, epidemic, or other causes beyond our control.

6.3 In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence by us, our legal representatives, or vicarious agents, liability shall be limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.

6.3 Any further liability for damages is excluded.

7. Applicable Law and Jurisdiction

7.1 The law of the Federal Republic of Portugal applies to the exclusion of the UN Sales Convention (CISG).

7.2 If the customer is a merchant, a legal entity under public law, or a special fund under public law, our place of business is the exclusive place of jurisdiction for all disputes arising from contractual relationships between the customer and us.

8. Final Provisions

8.1 Should individual provisions of these General Terms and Conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.

8.2 Amendments and supplements to the contract, the acceptance of which must be in writing, also include the waiver of this written form requirement.
